Oral arguments took place Oct. 13 regarding the city of Portland’s appeal of the Oregon Land Use Board of Appeals (LUBA) ruling in July that overturned the city’s new fossil fuels ordinance.
Oral arguments took place Oct. 13 regarding the city of Portland’s appeal of the Oregon Land Use Board of Appeals (LUBA) ruling in July that overturned the city’s new fossil fuels ordinance. The Alliance -- along with Columbia Pacific Building Trades, Western States Petroleum Association and Working Waterfront Coalition -- challenged the ordinance, which would ban significant new fossil fuel storage facilities. LUBA concluded the ordinance violated the Commerce Clause of the United States Constitution, as well as various land use policies and plans.
